Woman eats too much. Sues for damages. And people wonder why health care in America is expensive.
quote:
The woman, 62-year-old Germaine Mobley, says she went to eat at Asian King Buffet with a friend in 2016. A repeat customer, Mobley says that after her meal—she didn’t notice anything wrong. Court documents say that she, “purchased and consumed fried rice.”
quote:
Court documents say that “as a result of consuming the fried rice in question, Mobley ingested Bacillus cereus.” Bacillus cereus is a type of bacteria that produces toxins and can be found on foods that have sat out too long at room temperature. The Food and Drug Administration says Bacillus cereus is commonly found in fried rice and is the cause of ‘Fried Rice Syndrome.’ ‘Fried Rice Syndrome’ is a term commonly used to describe the illness people get after eating fried rice dishes containing Bacillus cereus. Symptoms include cramps, vomiting, and diarrhea. Those symptoms should only last about 24 hours according to the U.S. Department of Health and Human Services.

I mean she was in ICU for 8 days but

She admitted to having health complications before eating the rice, however. Knotts said that likely made her condition worse in the hospital.

If she can prove the fried rice was what made her sick, then absolutely i'd sue.
Full disclosure: My wife is asian (no pics) and i've seen her family leave food out for days then eat it. Its fricking disgusting, but they have iron stomachs.

I did a research paper as an undergrad on Bacillus cereus gastroenteritis in an Epidemiology class. It is an aerobic gram positive...so as food poisoning goes, there are things out there that are a helluva lot worse.

You can find a better example of this than the one in your OP. She ingested a bacteria because the restaraunt kept their food out too long at room temperature.

How do you know that the food was not st the correct temperature?
The article doesn’t say.
It’s ridiculous in the US with lawsuits. The lawsuits of these bullshite claims is what drives up the costs of health care.

Part of the cost to the patients to the Doctors...I'm sure part goes to the Malpractice Insurance these Doctors pay..$1 million ??? Ouch!

How do you know it was? If you eat fried rice and then get a bacterial infection commonly associated with fried rice then I think there is a reasonable inference that fried rice MAY have been the problem.

So if a restaurant may have caused you to be in the ICU for multiple days you would just shrug it off?

Healthcare providers in most states are extraordinarily protected with caps, prescription periods, panels, etc. The notion that lawsuits are what is driving up costs is a straight up lie

I try to avoid Buffets now..I don't want the runs...But I'm having second thoughts if there is a chance to scoop up $1 million Dollars!

United Healthcare stock is ~150% since 2014.
But no it’s those darn plaintiffs, not the insurance company in the middle making money hand over fist.

Your logic is that since we don’t know the temperature of the rice, the woman should get a million dollars. Ok and my original point still applies.
The cost of medical care in the US is outrageous because of these redicous lawsuits.
