If she can prove the fried rice was what made her sick, then absolutely i'd sue.

Full disclosure: My wife is asian (no pics) and i've seen her family leave food out for days then eat it. Its fricking disgusting, but they have iron stomachs.

I did a research paper as an undergrad on Bacillus cereus gastroenteritis in an Epidemiology class. It is an aerobic gram positive...so as food poisoning goes, there are things out there that are a helluva lot worse.

You can find a better example of this than the one in your OP. She ingested a bacteria because the restaraunt kept their food out too long at room temperature.

How do you know that the food was not st the correct temperature?

The article doesn’t say.

It’s ridiculous in the US with lawsuits. The lawsuits of these bullshite claims is what drives up the costs of health care.

Part of the cost to the patients to the Doctors...I'm sure part goes to the Malpractice Insurance these Doctors pay..$1 million ??? Ouch!

How do you know it was? If you eat fried rice and then get a bacterial infection commonly associated with fried rice then I think there is a reasonable inference that fried rice MAY have been the problem.

Healthcare providers in most states are extraordinarily protected with caps, prescription periods, panels, etc. The notion that lawsuits are what is driving up costs is a straight up lie

Your logic is that since we don’t know the temperature of the rice, the woman should get a million dollars. Ok and my original point still applies.

The cost of medical care in the US is outrageous because of these redicous lawsuits.
