Seriously, this should be all the lawyer for Asian King has to ask and case dismissed.

Your logic is that since we don’t know the temperature of the rice, the woman should get a million dollars.

Bull frickING shite. She should get a chance to prove whether the temperature of the rice was correct or not.

I'd make a million every time I ate Indian or Mexican.

Yes it is. Every time an insurance company has to defend this kind of stupid shite costs money.

They aren’t saying frick it. Insurance companies are there to make money. I know many people think an insurance company is just there to protect them in case of an emergency.

The definition of insurance is the transfer of risk.

Yes, but they transfer risk on general policies. The cost CGLI doesn’t impact Med Mal Insurance.

So what’s your alternative? If we further restrict plaintiffs and a doctor or a different company significantly injured or kills you or one of your loved ones, what are going to do?

I don’t see how this relates to medical costs. Seems like it would be an insurance thing for the restaurant if anything.

Fred, I don't see how the cost of healthcare has anything to do with a restaurant being sued. If it was the doctors or the hospital, then you have a point.

Healthcare providers in most states are extraordinarily protected with caps, prescription periods, panels, etc. The notion that lawsuits are what is driving up costs is a straight up lie

Not most, slightly more than half have a cap, but even in some with caps, there are exceptions. But to think this isn't a reason for driving up costs, idk what to tell you. Just because there are caps, it doesn't prevent death by a thousand cuts for the insurance companies.

I had a cop tell me a story of a time they got called to a Chinese buffet because the alarm was going off. When they arrived the entering the building and found hundreds of rats eating the buffet food that was left out and it had set off the motion detectors. Is it just apart of the Chinese culture to leave food out? I feel like I always hear of buffets leaving food out for days.

I think this could be very easy to mediate either way.
If the hospital did stool cultures and found the Bacilus in her culture, then it's open and shut. If they did not do the culture, then burden of proof is on her. If they did do a culture and nothing showed, it doesn't look good for her.

Defense can argue, however, that what is usually a self-limited illness was worsened by her pre-existing medical conditions, and therefore shares in the burden.

It plays a small factor. That's it.

Sure. Still a lot of options on the table.

Don't see how you drew that conclusion from what you posted. Looks like a big assumption to me, whether the rest of the suit has merit or not.

That kind of risk has a financial impact. Someone is going to pay for it. Insurance companies like other companies sre in business to make money. Someone (other policy holders” are paying for it.

I’ll never understand people with weak stomachs. I’ve never had issues with Taco Bell or chipotle.

Last time I had a hint of anything like that was after eating fire in the hole from pluckers and blazin from BWW in back to back nights.

Do you even read the quotes you posted? She got food poisoning from food sitting at room temperature, not from "eating too much". FFS
