Smith family lawyer getting blasted on twitter for initially saying Smith was not inebriated to the point that he couldnt drive.

Leave as quicklyas possible. Im not some billy badass who needs to keep heat in my truck. I've got young children and i've got car insurance. If I rear end someone and they threaten to kill me, im likely going home and im going to let my car insurance pay for the damage.

one person is in charge of everything. he may have some pressure on him from his boss you don't know that either.
I'm sticking to my notion that everyone was impaired and actin a fool. nobody "deserved" to die but they all made choices to get to where they are now

Just like TM's past had nothing to do with GZ shooting him at that moment.
Even though we know GZ's story is/was sketchy AF, was his life in danger "at that moment"?
If Hayes' attorney can somehow show that Hayes feared for his life "at that moment" he may have a chance at a reduced charge.
The two things that hurt him are the fact that he shot WS in the back and the fact that he shot Mrs. Smith.
Just an uneducated opinion...

No the burden is on the prosecution to prove that Hayes was not in imminent danger. At this point there has been nothing that I have seen would say that Hayes murdered Smith. With all of the information that is public right now, the prosecution has a case for manslaughter.

Absolutely, but Smith being drunk didn't then make Hayes' actions acceptable.

I'm not flaming you just curious.
there is a point where one cannot run away. I wasn't there and we don't have facts to support if hayes could have left the scene or not.

I think when they mentioned securing footage at Hustler Club and Ruth Chris' earlier that night we all knew he was intoxicated. Well, by WE I mean You, Me and Lester.

but it's his decision to recommend a murder charge and the 1 he will have to provide a reason for in court b/c you know he will be called to testify during the trial to explain his investigation

I would put it a different way. I would say, this is just another example of something he CLEARLY lied about (the other being the initial hit and run). And, because of his lies, it brings in to question the veracity of any of his statements.

Absolutely, the thing that IMO hurts him, are the shots in the back. Reminds me of the pharmacist who shot one of the kids who broke into his place and then went back to pump 5 more into the kid after the rest got away. He got life in prison.

after watching Weediquette on Viceland, I have full expectation that Leon Cannizarro will push for death penalty in the case where we have a Murder 1 conviction.
