if said drunk person kicks down your front door (here's my uninformed assumption that Bryce Dejean-Jones... the Pelicans player killed over the weekend... was drunk)... it can be deemed legal

right now Smith being drunk doesn't immediately make him a threat

naw but we know

- he left the scene of a hit and run
- ran a red light
- illegally possessed a firearm
- was driving while intoxicated

what we dont really know is what happened after the 2nd crash. Y'all keep saying he didnt deserve to be shot for being drunk, which is true. But we know he was acting erratically just minutes before the crash, yet you are going to fail to acknowledge that maybe, just maybe, the shooter was warranted in firing his weapon based on something Will SMith may have done towards him?

And Will Smith having a BAC of .24 could certainly help do that.

You're assuming a great many other facts. On its own it does absolutely nothing whatsoever.

I am willing to bet everyone at the scene was impaired and acting retarded.

Which is LITERALLY the only thing that matters in this case.

We have no facts to support this assertion yet.

It's not a smoking gun at all, but to dismiss this news as irrelevant is off-base.

like the pro-smith crowd is assuming a lot too. until we get some real witness statements its not clear what happened.

Guilty until proven innocent.

Hayes has admitted to it... now he had to give a why

apparently police and a grand jury didn't think it a good enough reason... that's why he was arrested abd charged with murder

now a jury will have the final say

I'm not assuming ANYTHING.

I said it COULD help. COULD.

I'm not dismissing it. I'm saying the typical TD jumping to conclusions is stupid. This doesn't mean anything unless its put into RELEVANT context, ie what happened after Hayes intentionally crashed into Smith's vehicle. It COULD have some bearing but as of now, it doesn't mean a whole lot.

Just wait and see.

According to the OT, it must be.

this board is so dumb sometimes. No one is saying that.

None of which is grounds for a civilian to put 8 bullets into him.

Less people are saying that and more people are acting like this is some kind of smoking gun, in my mind.

There's nothing to be drawn from this whatsoever without relevant context.

Who are these people? I only recall TigerFred saying it is looking more and more likely that he's going to get off. Other than that, I haven't read anyone saying that this proves Hayes' innocence.

many on this board generally has a stance of 'if he didn't do anything wrong then none of this may have happened, so he deserved it.' It gets brought up in almost every 'dindu nuffins' thread.

so...I am betting none of that applies here.

If you were hayes (stay with me now, this is a hypothetical), and you "rear end" smith.

again stay with me, all this happens don't say "i wouldn't have followed or some shite"

and a drunk smith gets out claiming he has a gun or Raquel pulls the gun. what do you do?

ask for an autograph?
