Would you agree the OT and Saints talk would normally call people driving with a .24 BAC and hitting cars and fleeing a huge TPOS?

this. the fact that will smith was drunk doesn't change the fact that Hayes put 8 bullets in his back and 2 bullets in his wife.

Will Smith was huge. 3X the limit for him isn't what it is for most. Not that he should have been driving. And not that he deserved to get shot and killed.

well we know it explains his irrational behavior. Which could have carried over once the 2nd crash happened.


We dont know how it affects the case directly, but without knowing all the facts regarding what happened after the 2nd crash, him being intoxicated could prove to be very important.

you put in front of a jury that he was DRUNK and perhaps how much it takes for a guy that large to be that BAC, and then maybe layer in that others in the car were as drunk or more.....

you might start seeing some of them question what other behaviors they were exhibiting in addition to drinking and driving, and the hit and run....

in a vacuum it doesnt change things, but a jury is hard to keep in that space. they often start to let their minds wander.

This doesn't change a thing, everything public up to this point still leads me to believe Hayes is guilty of murder

He's using self-defense as a defense. He needs to show that he was in imminent danger of losing his life and that the action was necessary to preserve his life (stand your ground doctrine could complicate it a bit). The burden shifts to him.

I agree to a certain degree, sure.

But of course the idiots are using this as some kind of smoking gun. On its face, its not a big deal. It could be a factor to consider once other more signficant evidence comes out.
