Don't think that makes it illegal.

So the gun was found on Smith and not in his vehicle now? Been a while since we've done one of these threads.

no... the gun was in the vehicle

people just pulling out the CCL statute now that it's come out that WS was apparently a little more than tipsy

still doesn't change all that much though really

I read that as being literally on my person, not just in the car.

I'm only an Internet lawyer though.

That is obviously the mature, correct choice, especially if you are carrying.

Not to mention if you value your life. Problem is, Hayes appears to be the type of person that was more concerned about showing someone not to disrespek him and was going to prove it.

fact is people are defending smith's actions because he was a saints player. I would have shot smith in the back if

I guess I would rot in prison but its better than dying

I'm not sure you know what facts are if this is what you call a fact.

So you are saying you advocate shooting an unarmed person?

He killed Smith. The burden is on him to prove that his life was in imminent danger. Smith being drunk doesn't do that

A split-second decision.

A big, drunk guy telling me he's "gonna get my gun".
I'd probably believe him.

That said, I'm going to do my best to not get in that situation.

That has no relevance to to what I posted.

obviously it's a high profile case b/c it is a Saints player

but I believe most people here are trying to see this in a logical sense of the law

Yes but Hayes chased after Smith by vehicle. Maybe Smith then got out and confronted him, but Hayes was in his car in the beginning and would of had to get out on his own accord.

I'm not saying Hayes shooting smith in the back is justified by the law, but I'm saying its more justified to shoot him in the back after a threat to grab a gun than just to shoot him in the back without a reason.

Kinda what I said earlier...

"At that moment" was Hayes in fear for his life?

Start a thread saying "drunk black man is involved in hit and run and then is shot after confrontation with hit and run victim."

See how many TPOS is now off the streets post you get in 20 seconds. If Smith wasnt a saints player, he would be a dindu TPOS "Play stupid games, win stupid prizes" contestant.

Now that changes nothing about the case, but it is a fact it has played a part in his defense by tigerdroppings posters

Was it ever proven who shot Smith's wife? I remember rumor that Smith may of shot his wife on accident first and that is why Hayes shot smith after hearing the gun shot? Something about Haye's gun only holding 7 shots possibly and him having 1 bullet left, 6 shots being in Smith, and so therefore the wife's GSW was in question?
