Right? I don't understand the issue. One man shot an unarmed man 7 times in the back. That seems to me like a pretty steep hill to climb to call it justified.
You didn't know? If you get into a fight with two guys outside of your car you can shoot them. That's what I learned in this thread.

"Unarmed" but he was reaching for his gun

Reaching =/= armed
And I'm not saying the defense can't climb that hill, im just saying it seems steep.

You think he wasn't?
that part is pretty clear

You better stick to contract law or whatever you generally practice.
According to your posts the only evidence that matters is Hayes shot Smith and everything else is irrelevant. You keep going on about case law. Not one person in that jury is going to read case law to determine their verdict.

The PT testimony is painting Hernandez as the aggressor. This gives the defense a lot more credibility to claim self defense.

of course you "can"
"should you" is another question
as well as "will you get a free trip to jail for it?"

Can you or anyone else give me a brief rundown of how this case will play out? I'm not talking about predicting a verdict or anything, but after the questions today, then what?
Just a little ignorant of the legal system
Probably a stupid question

There's never been any indication at any level that he was physically REACHING for anything

but not aggressive toward Hayes, who then shot the guy who wasn't being aggressive.

Im still having a hard time understanding why someone shot 7 times in the back is a threat.

Did they find a gun in Smith's car?
Posted on 12/7/16 at 12:55 pm to lsuhunt555
Can you defend yourself just because someone is potentially arming themselves?

Thats another point. Guy 1 swings on Guy 2, and that apparently justifies Guy 3 killing Guy 4? That doesnt make any sense to me.

If it is so irrelevant and only case law matters the DA must really suck. If all that testimony is being given without an objection by the DA when only case law matters then there is no chance Hayes gets convicted.

He said he was going to get his gun. He was already back in the car with the door open and the gun was within reach between the drivers seat and the console. You don't think that indicates reaching? What do you think he was doing, twiddling his thumbs?
