Your point? Did Hayes have a crystal ball to know there would be none?

OR he could not get out his car. Or call the police. Or drive off. Any number of things other than what he chose to do.

All of this stuff is completely irrelevant to the trial. Both parties were already out of the car. Both sides could've handled it better, obviously.

Hayes should have simply taken his arse whooping

There's no evidence that I'm aware of that he was even hit.

First of all, he exited the car with the GUN IN HIS HAND, allegedly. If he did that, then all bets are off.

If he had it concealed and has a concealed handgun permit, he can use the REASONABLE LEVEL OF FORCE NECESSARY TO FEND OFF AN ATTACKER.

Generally speaking, a guy taking a couple of swings at you and missing does not rise to the level of being able to brandish a gun.

If Hayes exited the car with his gun in hand its over.

If he had concealed his weapon and doesn't have a concealed weapon permit, or it was not a registered weapon...I would argue if I was the prosecutor that Stand Your Ground doesn't apply because he was in the act of committing a crime.

I have no clue what the case law says regarding that last tidbit.

No idea at all. Maybe tLSU knows.

You have to have imminent fear for your life to legally grab your gun?

this is How I would view it. smith hit hayes, hayes hit smith. smith got out of car and went to hayes. if hayes got out with gun in hand then its over.

Dooley: "I remember telling Will, just call the police, that's why you have insurance." She described it as "just an argument" before shots.

out of your vehicle in a public argument, yes. you become the threat when you have the gun out for no good reason.

That's some sharp intellect you have. I'm amazed you didn't survive the oil downturn with that big brain you must have.

I spoke with my dad. And he said you are absolutely full of shite here.

Now he said, I have been full of shite with some of the stuff I am saying as well.

But it no means does Hayes exiting with a gun in his hand make this case over. He said that is asinine an attorney would say that
