There's no evidence that I'm aware of that he was even hit.
First of all, he exited the car with the GUN IN HIS HAND, allegedly. If he did that, then all bets are off.
If he had it concealed and has a concealed handgun permit, he can use the REASONABLE LEVEL OF FORCE NECESSARY TO FEND OFF AN ATTACKER.
Generally speaking, a guy taking a couple of swings at you and missing does not rise to the level of being able to brandish a gun.
If Hayes exited the car with his gun in hand its over.
If he had concealed his weapon and doesn't have a concealed weapon permit, or it was not a registered weapon...I would argue if I was the prosecutor that Stand Your Ground doesn't apply because he was in the act of committing a crime.
I have no clue what the case law says regarding that last tidbit.
No idea at all. Maybe tLSU knows.

this is How I would view it. smith hit hayes, hayes hit smith. smith got out of car and went to hayes. if hayes got out with gun in hand then its over.

there is no such thing as a registered weapon in louisiana.
