I see two vehicles stopping and rocking forward and backward due to the abrupt stopping...nothing suggest there was a collision from this angle

Hyperbole, but you've definitely been team Hayes and extremely skeptical of Smith from jumpstreet. It is what it is.

Yes it is. When self defense is a claim the police are supposed to investigate.
Which they did through a toxicology report. A video from a restaurant is laughable. That's Fuller playing slight of hand.

Didn't they bring in the state police to look at this. I'm sure NOPD is clouded by their black and gold glasses like some of the posters here

We already know that Raquel was either too drunk to remember what happened or she's just a liar trying to protect her husband's name.
Remember when she (through her lawyer) claimed that they only had a little bit to drink that night and definitely not enough to be impaired in anyway? Also she (through her lawyer) somehow forgot to mention a person in their party going absolutely apeshit after the second collision prior to the shooting.
Racquel Smith's testimony is worth about as much as Cardell Hayes' mother's testimony on this case.

Maybe I'm confusing you with someone else then.
However I don't see much of a difference between Manslaughter and 2nd Degree in this particular case. 2nd Degree seems pretty appropriate...if self-defense/stand your ground doesn't stick.

Except for her being there and all. And getting shot.
She's a witness. A biased one but a witness.
It will paint a picture. Its up to a jury to see who is believable, not us sitting here on our asses.

He will be great on the stand. But he is biased as shite just like Raquel

Does this really matter if she lies or omits key details about the events that night?

this.
and the jury will be too busy trying to get drew's signature.

He wasn't getting cross-examined by a pretty darn good ADA.
We'll see.

The cross examination is gonna be a tricky one, for sure. Fuller needs to put doubt into the jury's mind without looking like he is badgering a victim.

Its up to Fuller to bring those details out.
Omitting doesn't typically hurt a lot.
An outright lie hurts a lot. Prove it, though.

I agree. Beating her up on cross might do more harm than good.

Typically I would agree.
A part of me wants to say that his strategy should be to just go after her. To treat her like a liar and let the jury know "I'm sorry I had to do that but she is lying and I am fighting for this man's life" etc etc.
It is a tricky situation to be in.

I'm not sure he can even do that, can he? They weren't her words that were spoken. They were her attorney's.

Well the tox reports call her a liar.
She said (through her lawyer) that smith only had a few drinks that day, and was in no way impaired in the least. Not only was he impaired, he was fricking shitfaced.
Don't feel like going back and reading the transcript of that presser right now, but with what we've learned since, I'd imagine the story that racquel told then is quite a bit different than the reality of what happened.
