No. It isn't.

There was fierce debate about this and it too several camera angles and it was still an EXTREMELY minor tap.

there was 2 people debating that they didnt hit and everyone else said it clearly hit.

Racquel Smith says they didn't think they hit Hayes's Hummer so drove away.

Is the defense going to wait or are they going to shove the video up her arse (so to speak). Seems like a tricky witness to beat up on cross.

I can't imagine anyone chasing after a vehicle if they didn't actually get hit. Makes no sense.

But watch the video. It is obvious they hit the Hummer, and nobody would not have noticed that

please post the video or even a gif would be better

Dude you are so biased here

Not even remotely. If anything judging from your posts, I am infinitely less biased than you. You've wanted to piss on Smith's corpse from the beginning. I don't personally care too much, but I dislike Fuller's...methods on a professional level.

ANyway, I had to watch the accident videos like 20 times to see a confirmed hit. Its there, but its pretty minor. I think about these things differently than you do. There was an INFERRED hit on much of the angles but not a confirmed hit. Later on a few days later we got an angle with a confirmed hit.

ADA: Did anyone make any physical contact with anyone in Hayes' Hummer? Racquel Smith: 'absolutely not.'

Racquel Smith says Richard Hernandez was not presenting a deadly threat. Judge stopped ADA Laura Rodrigue from describing RH as 'ridiculous'

In final seconds before shots are fired, Rebecca Dooley Hernandez and Racquel Smith are standing near each other, Racquel said.

I was saying you guys were arguing with each other about whether there was contact. We know chad said there was no contact.

well it's not obvious....plus I would think the guy taking out the trash would have heard something and looked over if Smith would have hit the Hummer, dude didnt even look over, he just kept on keeping on taking out the trash......there is some reasonable doubt whether or not Smith hit the Hummer

That angle definitely does not show contact. There is another that does.

You infer contact from that angle, which is not the same thing.

Not the police's job. That's the defenses job.

Yes it is. When self defense is a claim the police are supposed to investigate.

From Nola.com

quote:

Hayes' attorney reads a law to New Orleans Police Det. Bachelder that says when a self-defense claimed is raised, police "shall conduct a full investigation of the death and all evidence such shall be preserved."

No where in the law, Fuller said, does the law say "if you're what some people consider a nobody, that that law don't apply to you." Bachelder answered that the law "absolutely" does not have exceptions.

Bachelder agreed with Fuller that it is "best not to jump to conclusions," when investigating a homicide.

Hyperbole, but you've definitely been team Hayes and extremely skeptical of Smith from jumpstreet. It is what it is.

I'll let the evidence play out.

Hayes has an extremely tough hill to climb.

I believe Antonio Vargas said the guy from Juan's Flying Burrito is a defense witness in this case.
