I know y'all just want to keep arguing but Mordock is saying Fuller now had a case for a mistrial because Rodrique made a completely improper reference to protesters during her closing

He said he doubts it will be granted, but there is a fair case for a mistrial now

I agree. His testimony was stupid. Whats sad is he sat there during the whole trial, seems if he was going to make stuff up he could have done a better job of fitting what happened into what was presented.

Hayes claims Will fired at him before he returned fire.

I definitely think they missed some shots. A lot of hearsay on both sides, yet the state took the correct shots on the little minute things that didnt really matter which could possibly sway the jurors.

Only place i saw it was on the video of the witness someone here identified as justin ross. You can clearly hear him say both sides mentioned a gun in the argument. You cn see this on youtube search will smith crime scene video. Not sure why ross wasnt questioned on this or the video played. Seems like a failure on the drfense.

nope. As i said last night i dont even think they had to play this card. Hayes was in a good spot up until that point.

I assume a sequestered jury is kinda like being in a papal conclave

stay in a hotel... only people you're allowed to talk to over that time is the people also voting with you

Yeah, I can't figure out why defense let him get up there and testify to that. Once he did that, it opened up the door to clearly show he's lying about that. So what else is he lying about?

If he testified WS threatened to retrieve gun, then was heading to vehicle to get it, and CH panicked and didn't want to wait for it to be drawn, he at least had an argument that he had reasonable fear, and adrenaline caused him to fire too quickly. Multiple shots can be explained in that once he shot, he did so until threat was neutralized.

If I'm on jury, I think long and hard about that. But a phantom gun, and huge police cover up, with no corroboration evidence? What were they thinking?

Yeah hey definitely had all the momentum when it came out hernandez stirred the shite up and it was corroborated by all of the witnesses then you even had the guy with a great view out of his house say there was physical contact. At least up to that point you have nobody saying hayes had a gun out and its pretty much his word against theirs as far as did smith make a threat about getting gun.

Clearly the defense shite the bed with the conspiracies.
