He just went through a whole confrontation involving guys yelling racial expletives with his shirt off, 6'4" 280lb Will Smith confronting him, among other things, and all of a sudden he was afraid because Will Smith was "going sit in his car"?

I'm so damn glad I'm not on this jury and have to remember crap. Why should they deliberate and come to a conclusion based on their memory??? I really don't get why they can't take notes.

This is where i am at. The facts dont support that he did this out of rage. I think he got put in a tense situation and his mind played tricks on him. Without any witnesses saying smith said gun and the fact that his testimony didnt match with some of the evidence i say manslaughter.

Based on the evidence no I don't think Smith hit Hayes, not saying he didn't, I just have my doubts that he did. The video doesn't convince me.

The gun could be in a pocket in the door. Regardless, with the evidence presented I would need someone to have corroborated smith saying he was getting a gun.

If you think that was his motive for killing him, Hayes would have shot Smith right after exiting his vehicle. Yet all the witnesses that say Hayes labeled him as calm during the exchange

Why do you keep insinuating about the back glass being broken? Are you familiar with how flat the back of a g63 is? Are you familiar with how high the front of a hummer is? Didnt the expert say the collision occured at 18 mph? How many back glasses have you seen get busted out in 18 mph wrecks?

HAYES DID NOT TESTIFY THAT HE SHOIT BECAUSE WILL WAS GETTING A GUN!!!!!!
HE TESTIFIED THAT WILL SHOT THE GUN AT HIM!!!!
NOBODY corroborated many items in CH testimony. It came across as complete fiction. I think he overplayed his hand claiming that WS shot that gun.
NOT one single person corroborated that Will Shot anything.

huh? there are witnesses that said they heard Will Smith mention retrieving his gun.
Yet you just said he might be going to sit in his car to call the police. All while he just committed a H & R & running a red light with a blood alcohol level 2x the legal limit. Dude wanted nothing to do with the police.
