Yep. The defense actually had the lead at halftime

But they came out still running passing plays when they just needed to pound the rock. I think they were caught off guard by the states lack of ability to actually pinpoint a witness to say they viewed Hayes during the shoooting

CH immediately said "he had a gun. What was I supposed to do?"
Now how did he know WS hard a gun if it was holstered, between the seat and console? If they never find a gun in the car, then he lied. That's not the case.

Here's what we KNOW. We know Hayes was immediately honest about shooting. We know from testimony that Hayes was remorseful. We know from testimony that Smith was the aggressor. We KNOW the NOPD is extremely crooked.

I believe Hayes was the most honest in a trial where likely everyone lied some.

What if he's telling the whole truth? Smith and wife were at opposite front doors struggling over the gun in the glove box and it goes off, striking her and lodging in the door. Hayes hears this and draws his from his hip Smith swings left (maybe fires) as he's exiting and takes 1 to the side, turns back into the car and takes 7 more. Hayes puts his down tells KO to call 911 and guess cry. Someone, maybe cops, maybe friends, holsters the gun and wedges it into the seat.

Defense hasn't proven this to me, but they don't have the burden State hasn't proven otherwise beyond a reasonable doubt.

If WS shot at CH first and was right handed, he had to be facing him or facing interior of the MB. That said, return fire from CH would have struck WS in chest or RIGHT side, not left side or back. And, and, and why did someone shoot RS first?
