I'm just saying the question isn't whether or not Hayes held a gun or shot a gun, we already know he did.

It is still important whether Hayes was waving his gun around as soon as he got out of the car. So far no witness has reported seeing the gun before he shot.

So what you want to know is if Hayes was waving his gun around as soon as he got out of the car, not that he just had it in his hand.

I think when the gun is recognized kind of matters. It's almost like since nobody is admitting the presence of a gun, any gun of the 3 there, it happened very quickly. If O'Neal said he had a gun Hayes could have misheard him and thought will had a gun or will said something in response to that and was indeed going get his gun

It's in the prosecutions best interest to play dumb and just not acknowledge it.

Huh?? If he was waving the gun around in a threatening manner then all self defense pretty much goes out the window. If no one saw the gun then obviously this didn't happen. Is it really that hard for you to comprehend that?

Why didn't the prosecution establish by testimony who shot RS? They can't, because RS didn't see who shot her and WS was looking at her when it happened and even if he saw it, he is deceased.
Right now, they can't even put the gun in Mr. Hayes' hand, let alone prove he shot anybody. Unless they have test results on his hands they holding back.

I agree, it's better if the jury believes Hayes pulls the gun out of his waist, out of no where and just starts popping caps

I don't think you even comprehend what you're asking.

Do you want to know if he was waving it around before he shot or do you want to know if someone saw him pull it out very discreetly and start shooting?
