And once again, you would scare the shite out of me on a jury.

Maybe so which is why sometimes Jury trials aren't the best course of action for prosecutors but what he said is 100% reality!

It sounded more like a warning then a threat to me

So someone saying "I have a gun" is a warning, but an unarmed 5'6" guy saying "Im gonna kill you" is a threat?

An imminent threat requires perception that someone can carry it out.

O'Neill already testified that he didn't really perceive Hernandez as a threat.

So...there goes that, huh?

Yeah, O'Neil is real calming influence. Let's get him involved in the Korea situation. I bet he could help.

Honestly, I think he's going to get convicted, and I actually feel bad for him.

Hernendez and O'Neal were absolute POS and Hayes made a stupid decision IMO. I don't think he believes he broke the law, but I also don't think shooting Smith was justified as a real threat at this point either.

ADA Jason Napoli: Are you a member of the Will Smith fan club? Are you lying for him? Justin Ross: No.

He doesn't and I've said that from day one. He just has a really perverted view of the law, like a lot of people on here.

If Smith said he had a gun, Hayes thinks he can then shoot him and he's fine.

That just isn't the case at all.

Is that legal jargon, or what?

If Hernandez says that, it's not unreasonable to think he could have had a weapon. Whether KON saw him as a threat or not doesn't throw out him threatening to kill a person.

And Pierre testified that Hernandez was basically responsible for setting everything off?
