Ross is really helping Hayes' case here.

-Hernandez acting an arse
- he heard O'Neal try and calm things down
- heard someone in the Hummer say call for an ambulance

You can simply disagree


For me, its less about this case and more about precedent moving forward. To think that someone can make verbal empty threats and it cost them their life and the other person be justified is frightening as frick.

except he establishes that O'Neal is the only 1 throwing out claims of having a gun

The problem is from all accounts the person who did all of the above is still alive.

The reality of this is the jury is an Orleans Parish jury which is predominately african american with one caucasian kid who is a 20 something. The evidence and law don't matter one iota now that Hernandez issued his racially divisive threat. The jurors heard that and this group will make up their minds based on that type of rhetoric. Jurors in this case aren't college graduates and for the most part comprehend on a 3rd grade level.

No

third party witness has someone in Smith party say "I'm going to kill you n****"

third party witness say smith and party being the agressor, Hayes being defensive

gun found in smiths vehicle

Hayes says in recording a gun with smith was mentioned


I think that is enough for me to say the state is not going to be able to make a case that reasonable fear for his life did not exist

Unless they have a bombshell witness or evidence that they are waiting to use

How did Hernandez justify his behavior when he was on he stand? this guy is a true a-hole and it sounds like, got his friend killed.

This Hernandez guy my god. Sounds like he escalated all of this after the crash.

Can't believe he ran off and left his wife after hearing shots fired. There is no way I could leave my wife in that situation.

It sounded more like a warning then a threat to me. As in his testimony he said KON was trying to calm things. He hasn't been the first witness to say that
