Wife having a child while married that isn't yours

Having a discussion in the office that the OT may be able to clear up.

One of my coworkers is swearing up and down that if your wife gets pregnant while the two of you are married and has the baby while the two of you are married, that you are still legally considered the father and are still responsible for that child (in Louisiana) even if you are not the biological father.

I find this incredibly difficult to believe.

Surely, even with the system rigged against males, this can't be true.

There was a case recently about exactly that. The husband was on the hook for the kid that wasn't his. I'll see if I can find it.

In most jurisdictions, a baby born during a marriage is presumed legally to be the husband's. It is generally a rebuttable presumption.

I don't think that's true. A paternity test could clear that up and prove she cheated.

Unfortunately, he's actually right. I believe that the husband, whore, and biological father all have to sign a paternity affidavit to get it corrected and have an amended birth certificate issued.

Yeah, but the OP sounds like he's talking about knowing a kid isn't yours before it is born.

Raising a kid that you thought was yours is a different story.

Husband of the wife is presumed to be the father of a child. The presumption is rebuttable by clear and convincing evidence, but the state has an interest in not bastardizing children.
