Who are these lawyers? Do they represent family members or just your typical ambulance chasers?

Real estate/property lawyers. My wife was a witness when they signed the will. She received a letter from the law firm asking her to notorize her presence.
What kind of "bullshite" is this.

They were there, but I guess that is not good enough.

They want you to pay for affidavits affirming what has already been decided. Her children never contested the will.

My opinion of the bar is waning.

What is the 1/10th?

If you’re not it baller, the only think you really need from a Will is medical proxy and guardianship for kids. Maybe a testementary trust for kids’ protection

She then extrapolates the qualifications of a Notary Public.

My wife signed the papers in the presence of said "lawyer".

I'm not saying that circumstances change.

I'm saying that..

Why, without any of her children contesting this, they have to contact attorneys and pay for affidavits.

It seems to me to be a scam. An excuse to charge fees.

The only thing that makes any sense in what you’ve posted is that the house was willed to her and her kids when her husband died. She sold the house, so whoever buys it wants assurance that the kids won’t come back later and claim that she had no right to sell it.

State. Georgia.

No mortgage.

Mental health has never been an issue.

Her husband gave her everything when he died.

No contest from her children. Then or now.

Why do they have to give affidavits again?

and pay an attorney for this.

Some facts are still missing, but sounds like maybe the deceased husband's name is still on the deed for the house. But that should have been cleared up by the closing agent.

No idea why a will is involved, unless the deceased husband's will was probated when he died. In most cases that doesn't happen, and all assets just transfer to the spouse automatically. Her will is only a concern after she dies, as far as I know.

This does smack of some CYA by somebody. Maybe the title insurance issuer? Not sure about the vagaries of George real estate/probate/succession law, but none of the OP's understanding of the issue is either complete or on point.

And to the original point - she's not giving her assets to her heirs, she sold them. And having a will or not appears irrelevant to why these folks are getting affadavits (or whatever these are) executed (based on the facts at hand).

An in vivo transfer has nothing to do with a will.

I’m going to write a will and intentionally pack it with legal issues so it gets tied up in court for years. My last frick you to everyone.
