re: Why do “squatter’s rights” exist? It’s beyond messed up.

If it comes to the point where you’ve called the police and they won’t make them leave, can’t you just quietly wait for them to leave and then squat it right back? Change the locks etc...?

Not surprising that cops wont do much...

But even if you could, the types that do this I imagine surprisingly know this part of the law very well so they probably plan to always have one of the squatters in the house or some shite like that.

Although you might feel tempted to break into your home and physically force the squatters out, shut off all utilities, change the locks, or take some other action, be careful. Because of squatters’ rights, you could end up on the wrong side of the law. Although frustrating, if the squatters refuse to move out of your house, your only recourse is to take the legal route.
Didn't answer my question really. I might just be misunderstanding how squatter's rights work, but is it wholly their property? Like am I no longer entitled to walk back into my house?
I guess I was thinking that the squatter and myself would still have rights to the property together and so was suggesting if it's a problem to just walk walk in calmly with your key, set up a drum set, and start bashing away. But I guess the co-ownership thing doesn't make sense I'm wrong and that would technically be me breaking in to my own house.
But hey, if I catch him leaving for an hour and walk back in and lock the door behind him how the hell is he going to prove that he has squatter's rights? What's he going to do? Call the cops? Can I not just say I don't know what the hell this guy is talking about? This is my house, here's the deed? How exactly does a squatter prove that he's been there for a an hour or a month?

Oh trust me- they'd be leaving.

quote:No but it sounds like they have rights along the lines of a renter at that point. A renter who apparently rents for free.

Deny it?
Go inside, tie them up, throw them into a closet, clean your shite up, give yourself some scrapes/bruises. Call the cops and tell them they assaulted you and won't leave. Who are they going to believe?
Squat with the squatters?
Idk, i'm just spitballin here. There seems to be a million loopholes around this.

Just throwing out that these people that do this for a living know what they're doing and probably have their ducks in a row to get away with it.

There have been cases in New Orleans where the squatters filed a forged lease or deed to property. When the police came, they showed the forged document and the police let them stay. Took months to get them out.

They weren't entitled to your house in the first place either. Wait until they leave, and say they invited you to live there just like they said they were invited

Idk man. They are people incapable of securing permanent residency. They likely have mental illnesses. I don't think it would be too difficult to outsmart them.

That's probably what they want you to do. Then they call the cops, you get arrested and probably a restraining order. Now they have your home and don't even have to worry about you coming around any more.
Incorrect. I bail out of jail. Return. And get them the frick out of my house.
Also please link me one time a rightful homeowner has ever gone to jail for removing squatters.
It is quite simple. They are in my house. I remove them. And now they are gone. I don’t care if they call the cops after that. A cop is going to knock on my door at my house and then arrest me? bullshite.

It's not a very realistic scenario for this to happen in your actual home as opposed to a rental property. Anyone who is capable of being away from their primary home long enough for squatters to get in is most likely going to have an alarm system. They try to break in, the alarm calls the cops

It doesn’t matter to me whether it is my private residence or my rental property.
Let me be very clear. I would accept any and all repercussions that would “theoretically” come my way for breaking the law and removing squatters. In reality, there would be no repercussions. There would be no jail for me. I would just remove them and then it would no longer be an issue.

PHILADELPHIA (WPVI) -- A property owner has been arrested after a squabble with the squatters in his property in Philadelphia's Germantown neighborhood. And police say the squatters can stay.
"I was like, 'Who the ... is in here?' because I changed the locks Thursday. I'm just like, 'What the ... is going on?'" landlord and property owner Kaiem Frink said.
Frink says squatters took over the top unit of his home at 24 East Tulpehocken Street last week.
Police arrested Frink and his friend.
Court documents show both men are listed as co-defendants on a string of charges, including burglary, criminal trespassing, making terroristic threats and simple assault.
"This is the most boggling aspect of this, he's charged with burglary of his own property," said Sciolla. "And the offending party, the people supposedly offended by his burglary, are the squatters who have already broken into his property not once but twice."
A police authority says Frink and his friend were arrested for allegedly threatening the complainants with baseball bats.

Pretty crazy.
There’s probably not many news stories for the thousands of times a property owner just takes care of his business and cops don’t act like fricking idiots though.
