The problem for Tennessee is going to be how long it was there before it was destroyed. Most states have a 30 or 90 day requirement. It he destroyed it before that clock ended, then he might beat the rap.
This is not how it works at all
It's kind of how it works. Per Google:
quote:
You have 30 days from the date you bring the vehicle into Tennessee to register it. To register the car, you will need to visit a county clerk's office with the out-of-state title, proof of Tennessee residency, a valid ID, and proof of insurance.
So if the car was totaled before the end of the 30 days, then he wouldn't be on the hook to register it. Don't know where the taxes would fall.

Yes you would. You have up to 30 days. That doesn’t mean if it’s required to be registered you don’t have to if you destroy it before then.

Tax is due upon first use and since it was used in a video, tax would be due on his next required return. That may be monthly, quarterly, or annually based on filing frequency as established by the Department.

I also think that the not filing is part of the fraud. Like with how Dave Ramsey talks about federal taxes...not paying gets you a letter. Not filing may get you in jail...or putting in false information in that return. That's where you really get in trouble.

I’m not disputing that this is a bit of a witch hunt with the other shite I guess he’s fought the state/county on as rolling a dude out in cuffs is not SOP on this type thing.
But pulling this shite of registering in Montana to clearly avoid the tax is one of the only things that actually pisses these Departments off. You can make as many mistakes as you want and they’ll generally work with you on getting it fixed and payment plans and such.
But willfully evading the tax like this or collecting sales tax from customers and not remitting are the two big things that will lead your arse to ending up in jail.

We're talking about sales tax not revenue earned from his video. Since in the taxes are due in Tennessee upon titling and registering the vehicle, if the car doesn't survive to 30 days because he destroys it in his video then this creates a gray area to where the taxes are never due.
Anyway, us arguing on here isn't going to solve it. That's the job of the courts. Good day.

Yes. Montana is known for the best state to incorporate for companies that deal with large volumes of equipment, machinery and auto-vehicles.
Montana is good for that.
And Nevada has some lucrative benefits for forming in their state.juts all depends on what type of company you have and whether or not you can meet the requirements to do it legally.

I know you fricking retard. And not all revenue may be sourced to Tennessee depending on state sourcing rules and where the video was being produced.

It’s not gray at all. “Use” means placed in service. The car was used to be destroyed for a video which is indisputably placed in service and tax was due.

We’re not arguing, I’m educating your dumbass on shite you are talking out of your arse on.

And I know exactly how the court would rule, but this will never get to court on the tax matter because there’s nothing to dispute.

Do you know what state it was destroyed in? Bet you don't.

Presumably Tennessee where he films almost all of his videos. What point are you trying to make here?

So WD gets no due process?

Texas. He destroyed it in Waco. It was in use in Texas likely way longer than it ever was in Tennessee. That's important.

He’ll go to court on the evasion charge but their defense wont be the tax wasn’t due… because it absolutely was and no competent attorney would try that

That’s not important at all. Tax is due upon first use. There could be incremental tax due based on the fair market value and credit for tax paid upon moving the vehicle, but if first use was deemed in Tennessee, the amount of subsequent use in Texas is irrelevant to Tennessee

Yeah, that's not true. Look I think WD is an idiot in his videos, but I also know he's WD is super petty. He'll fight the state just because he's got a boat load of money and on general principal. With as much money as he's willing to throw at a lawyer, he'll find someone to take the case. I'm not even sure if he cares if he wins or not. He'll just make the state spend more $$$ in lawyer costs than they'd get from him in taxes. He'll monetize the whole thing on YT and come out financially ahead on the deal. If he can buy and destroy $500K cars and make money on the videos about it, he'll rake in the cash on this one too.

I’ve got no idea who the guy is so maybe. But he’ll lose because there’s no gray area in the law here.
