Where do we draw the line between mentally ill or a bad person/criminal?

I have a family member who has been getting in trouble for as long as I can remember. She is very smart, but always ran with the wrong crowd, got into drugs, all that lifestyle...

She has also always been mentally ill. Bipolar depression, antisocial personality disorder, to name a couple. This is why I have always been of the opinion that it was never the drugs that were the problem, that was merely a cover up of the underlying conditions. The drugs were always addressed, the underlying conditions seldom.. From an early age she exhibited these types of behaviors; lashing out, etc...

Now she is looking at prison time for repeatedly getting in trouble. This is not to say she did not have her chances. She has had a countless amount of chances.. but she has also never been properly taken care of mentally.

I think some type of psychiatric treatment facility would be much more beneficial to her than a prison... but living in Alabama, where mental health is basically not even treated anymore, not many options exist...

Kinda venting, kinda wanting your opinion. I'm sure BS responses are incoming, so..

so what do you think? Are criminals always bad, or can it be non treated mental illness rearing its head which lands them in prison or worse?

I know she has in the past, not positive on how regular she stayed with it tbh

Were these diagnosed and was she treated? If yes, then she is simply incorrigible.

I think it’s pretty common for people with that disorder not to take their meds, they don’t get that manic high with mood stabilizers, she’s doomed if she doesn’t keep up with the medicine prescribed.

Yes or no.

Everything else is mental illness yes, but it doesn't effect knowledge of law and consequences. All of that is treatable.

If, at the time she committed the offense, she knew that what she was doing was wrong, then she's a criminal.

It's amazing how many "bipolar" people I knew that suddenly learned to cope once daddy cut them off, and they had to get to work after college.

Half the people in prison are mentally ill. I don't think there's a treatment for a personality disorder. Better in prison and crazy than on the streets and crazy.

I think a large portion of people that are diagnosed with a "mental illness" know how to work the system and use it to their benefit....they're not really mentally ill. Just lazy, trashy, and mentally stupid.

Take for example...a girl/baby momma that my wife's brother has been engaged to for 10+ years (they never got married because her benefits would be taken away) claims she has all these mental illness conditions and can't work because of it. Meanwhile while he is busting his arse working offshore and she is cheating on him, doing drugs with other guys, pawning their kids off on their grandmother, loaning other crackhead guys her their vehicle and then claims it was "stolen" when he didn't come back with it several hours later...but she had been hanging out with the guy all day (all of this while fiance is offshore working). She claims she can't work though because she is diagnosed with epilepsy, but hasn't had a seizure in years.

ETA: Her fiance (my wife's brother that works offshore) is a huge part of the problem because he is in denial of everything and turns a blind eye towards it when we bring it up.
