Granted, this might very well be true, but holy shite how are you supposed to know someone's mental state without an expression of such? Without an objection, one assumes passive consent.

ETA: This is a generalized statement and not necessarily applicable to this case.

Things are a lot less complicated when you're not having sex with someone you picked up in a bar. This shite usually doesnt occur with someone you know and who you know likes you.
