Cops report says he told him there were 2 or 3 people in the vehicle. Unfortunately for Mr Brooks, he only subpoenaed this guy and not the cop who wrote the report.

Again, if Brooks had a lawyer to represent him, he would know how to deal with a witness that claims to not remember what was written in their initial report to police.
Then again, the lawyer wouldn't have asked his witness how many crimes he's committed, nor would he have even allowed it to be relevant because he'd argue the man is rehabilitated.
Not that any of that matters because a single eyewitness in a chaotic event doesn't necessarily constitute reasonable doubt in anyone's mind except Darrell Brooks.

This guy's initial statement is very good for one of Brooks' 3 defenses that he wasn't the only person in the car. An actual lawyer could probably have gotten him off of the intentionality of the crime but he's an idiot.
ETA: I think he intentionally did it because he is a black supremacist with anger issues but an actual lawyer, based off of some of these statements, could've helped him tremendously.

The prosecution might have to do the rehab work (back off the 7 convictions) so his ID of Brooks as the driver can stand

Agree 100%. It makes the cops look incompetent for writing that report OR it makes the witness look unreliable.

I don't know. They probably will cross, and they are the professionals who know way more than me but I might let his 7 convictions stay in the mind of the jury that he thought he saw 3 or 4 people in the car. Not a single one of his witnesses is going to keep him from being convicted of the 6 murders and life in prison without parole.

I agree. This guy is probably Brooks' best witness. A good lawyer would've done well here. I think on cross, the prosecution will ask him if he only saw the black guys near the vehicle and not actually in the vehicle. Maybe some questions about was he scared, in the middle of an event he considered chaotic, etc. to rehab this one.

Yep. The witness saying he saw someone get hit so hard that they did a cartwheel in the air completely demolishes any point Brooks was trying to make on direct.

This ranks right up with his pronouncing "tacit" as "tacket".
And now when the prosecution asks the witness if he had a conversation with someone about the event, Brooks objects that he thinks it's hearsay.
