a-hole could have been caught then used as a bargaining chip against us. with tensions rising between us and NK this was a horrible idea.

There is no American embassy in North Korea. There is no official American presence at all in North Korea. You're f'ed if arrested in North Korea.

I was wondering about this after reading "he considered taking refuge in the American embassy" so I googled it and as you stated, there is no American embassy and if something happens to a U.S. citizen while in NK, the US only has limited power, which they have to go through the Sweden embassy to get.
So if he would have gotten caught.. He would pretty much be fricked.
