The rules may be stupid, but in intentionally not following them, VW lied to their consumers and cheated to gain a competitive edge in Diesel engines over Toyota, Chevrolet, Ford, Honda, etc.
Like cheating on your spouse, with white collar crime it's always the lie that hangs you. And this is an easily-proven whopper coming from someone with very deep pockets. Their only hope now is that this cheating can be proven to be practiced by the entire industry. Stay tuned.

I'm sure they will.
It's incredibly difficult to near impossible to meat EPA diesel emission standards and still have a reliable driveable vehicle. The EPA will likely cherry pick who they want to bust though. They're a fricked up organization.

If they have now included the 2013 Passat, where do I sign up?

Try the included link.
Edit to add below.

Performance gains unlocked with our tuning are simply impressive. Have a look at the chassis dyno plots above and note the peak to peak power gain of 22% and peak to peak torque gain of 34%. Also note the consistency of the power and torque curves. A more consistent torque curve means a wider and more predictable power band for you the driver. This also minimizes additional stress on the vehicles' engine, clutch, transmission, axles, and driveline mounts. We have also seen a mild yet consistent improvement with regard to fuel economy on the order of +10%.
