I wouldn't call it victim shaming exactly. however I do not see how his alcohol use and pot habit is relevant in this case since they were made to drink a frick ton of alcohol. Dude still took things a bit too far.

Kids drink when they get to college. I’m pretty sure the Ancients described it in detail. 35 years later I can tell you every drink special at LSU from those days.

I'm not saying the dude is right or wrong, but of course he's going to say anything to try and save his arse. I've always been of the opinion that if I were in Gruver's situation I would know when I've had enough and would have stopped myself. But I don't remember shite about being 18 and I might have very well succumbed to peer pressure. Sad story all around.

tragic death however you look at it, and I know nothing of the details, however if he was high and drank a lot (by force or otherwise) you lose some of your ability to throw-up so it appears possible this would be part of the argument..

This whole case is ridiculous. The dude drank too much alcohol and died. It sucks but it happens. No need to ruin another persons life.

If that kid’s parents didn’t want him to be a nonstop partier, they shouldn’t have named him Max Gruver.

It is relevant because there were 20+ other kids also being hazed that night and only one of them died.

The defense is trying to build a case around a story that if the hazing was so extreme, why weren't the other kids also near death? They will try to say that it wasn't the hazing that killed him but his own lack of limit control.

They will say that the hazing was the vehicle that killed him but that Gruver was driving that vehicle, not the Hazers.

I am not saying this defense is right or wrong or whether it will work but it's obvious that's what they are going for.

I'm not sure admitting it would make a difference in the jury's decision. The kid's BAC was .495, which is so high that I don't see how anyone can claim that they just assumed Gruver was drinking the same as he normally does. This will be an appealable issue though for the Defendants if they're convicted.

That's not relevant when they are trying to prove that Max was singled out

If he was high when he showed up for the "hazing, you could argue that he was not of sound mind to make proper decisions, therefore putting responsibility on the hazer

They're appealing the decision now so I doubt it will serve as a reason to appeal if convicted
