The issue is that the property rights you reference do not include the right to seize and destroy that which travels onto your property.

TBH, my first response would not be to grab a gun and go all Daniel Boone on the thing.
I would've looked for my neighbor flying the thing and asked him politely to not fly it over my house.
More than likely, it was a sixteen Y.O. boy checking out the girl.

A neighbor of mine is a sheriff's deputy and the guy responsible for all of the department's drone inventory. Practices flying them daily. I considered telling him to not fly around my house, but I prefer to keep him as a ally.

I dont think it matters whether the drone is 500' or 5' above your property, under current laws, a drone is considered to be an aircraft. Gizmodo wrote an article a few days ago....

Lets say his teenage daughter is in her own back yard behind a privacy fence and his laying topless sun bathing.
She is a under age teenager and they find pictures of her on the drone. Can the owner of the drone then be charge with child pornography and be tagged sex offender. I think the should as he is invading the privacy of this mans daughter by flying this machine over there house snapping un-wanted pictures of his daughter and family.
Who is to say the owner of the drone is not also using it to case out the neighborhood for future break ends and robberies.

It's not hick, it's called being responsible. Expressing concern about the unforseen implications of a new technology is not unreasonable. People want to protect the safety and rights of themselves and their loved ones. Blindly accepting technological change as absolutely positive is childish.
