List me the good measures the cops took.
There's none.
They drive up fast on an unsuspecting 12 year old, jump out of the car at a close distance, and start shooting without any hesitation. How is that properly addressing a situation? which was a non-threat one btw. Gun was in the 12 year olds pants

Talk to him from where? In the car? A death trap according to you. Behind the door? Pointless according to you? Behind the car? Then you have to get out of the car and expose yourself while you try to take cover behind the car.

I'm not saying they did it correctly......just that approaching in a vehicle and contacting the subject within 30-45 feet is the correct tactic.
Also, performing a certain tactic wrong is not murder. Liable civilly...yes. Criminally...no

May not be murder but that doesn't mean it wasn't criminal either.

What criminal charges do you see they committed?
I think its gonna be hard to get past that airsoft pistol that looked like a real gun. Its gonna be hard to convince a jury that a reasonable person would have known that wasn't a real gun.

Somebody post a pic of the gun if you can find it. It sure as hell looked like a real one, esp. when you don't have time to study it.

This.
I'm normally on the cops side but the video is plain enough to see THEY fukked this one up. I emphasize "they" because the driver plainly put the passenger in a position of danger. He had to get out. The door is no protection. If he is going to exit the door he better be ready to take action. In this case he chose the wrong action. The driver plainly has some culpability.

Spoken like a guy that has never worked a day as a peace officer. It's easy to Monday morning QB, but to actually react in the situation is another thing. There's a whole bunch of 'dumbassery' in this thread.

That's fine and all, but poor decision making resulted in a dead 12 year old. I'm all for giving the cop the benefit of the doubt that after he got out of the car he reasonably believed that the kid was reaching for what he thought was a real gun, but it was a very very poor decision to approach this kid in that way. Does it deserve a murder charge? Probably not. But a kid is still dead because of a poor decision. The kids actions are not to be excused either, but he is 12.

I would be willing to bet big money the outcry would be no different if the kid had a real weapon, it would have been the same.

And let's not forget they didn't administer first aid until at least 240 seconds had passed.
The shooter was a known emotional wreck who couldn't keep his job on his previous force.
The driver was an idiot to come blazing in there like that.
Nothing about what these cops did was defensible - before, during or after.

"This court reaches its conclusions consistent with the facts in evidence and the standard of proof that applies at this time," the judge wrote.
