a.) You don't really know that he has no criminal history. Even his friends posting here would not be sure of that.

b.) Everyone on this board knows someone or more than one person from college or what not that could get violent when they were drunk. It's very possible this older guy mouthed off at him or something and he beat the shite out of him.

Those are the only "facts" we have presented to us at this moment. Do I need to put alledgedly on every post so you don't get in a twist? The arrest warrant stated he kicked him in the head on the ground.

Bringing up that McKnight witness statement that was dispelled before the arrest warrant was issued is absurd.

First off, no one can reasonably plead to being ignorant to the effects of drugs or alcohol. They all alter your state of mind.

Second, there's a lot more involved than drugs or alcohol if you go from a nice guy to potentially killing someone accidental or not. That's simply not normal.

I am saying you running with witness statements as fact is pretty absurd, considering how common it is for witness testimony to be flawed or downright false.

But the cops did so....they probably felt it was solid or had some other reason to believe it was true since it was stated on the arrest warrant.

They don't really need witness statements to figure out if the guy was kicked in the head while on the ground. The doctors could clear that one up.
