The state says she was intoxicated so by their own accusations she could easily have misunderstood something he said or remembered the encounter wrong.

Problem is the cops are smart enough to accidentally turn them off or have some other “malfunction” when they are the ones doing something wrong.

Actually the cop did that field sobriety exercise (Horizontal Gaze Nystagmus) about as well as you could ask. Most officers rush through it and don't do the correct number of passes for the right amount of time. They get to court and a knowledgeable defense attorney tears them up on the stand.


Well then, it is a bad law or poor training and it needs to be changed.

Having someone stand feet together, hands down at their side with their head tilted up slighted due to where the light is held, while shining a flashlight in their eyes for 3 minutes straight and telling them to follow the blue light which is moved to the extreme of the vision and beyond while not moving their head is ASININE - drunk or stone cold sober.

I mean that shite is retarded. Shine a flashlight in my eyes for 3 minutes straight while doing all of that and moving the light way left or right and telling me not to move my head is going to be about impossible. Not too mention insanely annoying with a flashlight in my eyes for 3 minutes.

I'm stopping the test and telling the cop he is through testing, unless he removes the flashlight from my eyes after a couple of minutes and moves on. It is my decision whether the cop is allowed to do anything and at that point, the cop is done, cut off and can decide whether he wants to take me to the station and see what I blow.

Not only were the claims false, he was extremely cordial to her. Amazing how calm a good law enforcement officer remains when faced with adversity.

His dad was apparently a light skinned black guy.

But his mom is white, raised by a white dad, and fricking looks white.

I highly doubt he suffered too much racism that real black people might have suffered.

Our local news investigator does the same shite. He gets tips on something and reports it as fact and how he is going to get to the bottom of it. Then when he finds out its false he just moves on to the next story

Well the presence of horizontal nystagmus has been proven to be accurate in determining intoxication.

And the method in observing them has been tested and proven over and over again.

Furthermore, you don't even know what the test is looking for or how it works.
