UofCincy tribunal expels student despite evidence that investigator was banging accuser

Student is now suing the school and others, he recently won on some motions regarding dismissal of his case.

The tribunal refused to hear any of the evidence regarding the affair, and did not ask a single question about it to the investigator and accuser. They also did not ask about a signficant amount of deleted texts between investigator and accuser.

If I was this dude, I would not only sue the school, but not accept a settlement so everything found during discovery sees the light of day.

Hopefully he was something like a premed student so that he can claim all future lost wages.

I wouldn't go so far as to say he should be vindicated though. It sounds like he knew she was beyond coherent. I think if punishments are put to all parties, I would be fine with that.

I think that if a crime occurred the police should deal with it. I don’t see it as the schools business. If they want to kick him out after a conviction then fine.

That portion of Title IX was one of the worst policies ever inflicted on the education system in the history of the US
