lol no. The only reason he got his arse kicked was because of his own stupidity.

It all boils down to the definition of "boarding."
I just don't see a way UA can fight this and not have any major repercussions, whether legally or in public relations.

I don't know why we have to find a singular source of blame. The world doesn't work that way.

Their employees can fly for free on the next flight that has room.
I agree that United royally fricked up the way it was handled. The employees should've never been on stand-by to begin with and United should've never boarded passengers that would've had to be bumped. United should've continued to increase their compensation offer for someone to voluntarily give up their seats...eventually someone would've taken the offer when it got juicy enough.
BUT...the next flight wasn't until the next afternoon. If those 4 United crew members didn't make it to Louisville that night, then it would've caused major problems for whatever flight that crew was scheduled for the next morning.

That he paid to be on.
And they were refunding his money for (and then some). Its no different from when you order something online, and then they send you an email that it is out of stock.
Once told to leave, the guy should have left; and these days, once you make a ruckus on a plane, it's over for you. He decided to whimper and go limp instead of just acting like an adult.

Oh it's that simple huh? OT never ceases to amaze.

Aside from the legalities, this is a terrible business model and invites this kind of bad press.

Would have been a lot cheaper just to cough up a few hundred more in credits until they found a volunteer.
Or, as others have mentioned, put your four employees on an Uber to Louisville.

Put yourself in that situation... You have to go work the next morning to see clients, you're next to your wife or girlfriend, assuming you have one, and she doesn't have to get off... Which put things in a bad situation as well.. So she has to get off...
Frick that, I hope United pays through their arse..
I get off and bitch until I get a free voucher and hotel stay for my wife and I. No one gets fired for missi g a morning, unless they are on the verge of being fired anyway. Especially not fricking doctors.

They'll fight it for a while then settle. Passengers attorney will take 40% and everyone will be happy.
It's not whether or not the plantiff has a case, it's how much will it cost to defend vs what they'll take as settlement.

No, it doesn't. It is revocable at any time.

Serious question, do you think people with a valid lease have a right to stay on a certain property? That a contract can enable a person to certain legal privileges?

True dat. This jackass could have handled the situation better and probably made a better deal for himself rather than getting his arse dragged off the plane and made a spectacle out of himself internationally.

You're checked into a hotel, getting your luggage unpacked, and getting ready for bed and hear a knock. "We need you to leave because one of our employees needs to use your room."

All BS aside, he really shoulda just got up and walked off as the others did, and UA should have just kept upping the voucher value
Exactly, he should have just used the opportunity to get a couple free flights and a hotel from United. That's what sane adults would do.

quote:The fair comparison quite possibly is having a signed contract to be in that store or on that property and doing nothing to breach the contract, then being told to leave.
Just like being told to leave a store or private property and you don't after LEO asks you to. You gonna get your arse drug out.

His actions are the only reason the situation went as far as it did. The world does actually work that way.

I dislike most of the airlines like everyone else, but the legality of this case does fascinate me. From a business standpoint, United fricked up royally, but I'm not sure if they violated anything in their contract of carriage.
No, but they seem to have likely fricked up their bottom line. Dude took a stand against bullshite I didn't even know was possible - taking paying customers off the plane for employees would have made me livid.
