There is plenty to suggest the flight was oversold. You wont see the difference in oversold and overbooked. United has an out, because if they didn't hundreds of passengers would have been able to sue otherwise.

Again, what is the prescribed check-in time? It's not logical to say after everyone is on the plane. And the contract suggests it is actually 30-45 minutes before check in, if I recall.
So again, there's also evidence to suggest oversold doesn't apply either.

DOT required that crew to get to the next destination to do pre-flight. United had no choice

Now you're reaching. Check-in is just to let the airline know you are at the airport. Checking in lets the airline know they cannot give your seat to a standby passenger or employee (not the must ride employees in this situation). Checking in will assign you a seat to speed up manifest makeup, that is all. The seat will usually be the one you chose, if you did. Checking in is not an end all be all list. The manifest is not finalize in any manner until the gate agent hands it to the pilot and shuts the door. They cannot depart without knowing who is in what seat. They can arrange seating as they see fit before departure.
So no, there's no evidence to suggest oversold doesn't apply because they obviously didn't have enough available seats.

Let's regroup here.
On Monday I believe, UA spokesperson said the flight was not overbooked. Most posters on the other side of this argument said that was irrelevant because it was oversold.
On Tuesday, a UA spokesperson said the flight was not oversold.
So back to square one, under what provision was the passenger being removed?

Direct link to United? Because I've seen the terms used both ways in titles and articles in the media, and we know they get things wrong. What term did United use? The only term I see is oversold, in context to how they will review oversold situations.
