If only people would obey the law then none of this senseless violence would occur.

LINK

quote:

An unknown number of sheriff's deputies showed up at the trailer where John Livingston and Clayton Carroll lived at 3:30 a.m., looking for someone as part of an unspecified "assault investigation." The cops were apparently told the person they were looking for no longer lived there. According to Carroll, they asked Livingston if they could enter the trailer. Not without a warrant, said Livingston, who then closed the door on the cops.

"The cop kicked in the door, got on top of him, started slinging him around beat him…" Carroll said.

quote:

Carroll said sheriff's deputies then started spraying mace on Livingston and using the Taser, according to the roommate.

Witnesses said Livingston was not fighting back and was trying to get the Taser out of the deputy's hands.

quote:

Under North Carolina's Castle Doctrine law, Livingston had the right to use deadly force, in and near his home, to repel the sheriff's deputies unless they were lawfully performing their duties. The absence of a warrant, and the sheriff's office protecting the names of the officers and declining to provide more information about the investigation that led to the home invasion, makes whether the cops were acting lawfully far from obvious.

They did. Twice before arriving for the third time at 3:30 to ask again.

Would like to know where that is cited

Again. frick them. They should have gotten their arse beat at age ten and not 20. Maybe this wouldn't be a problem today for the cops to deal with.

Yeah, how dare they use their Constitutional Rights. Punks. They should've done whatever the crooked cops wanted them to do.

Use of that excess of a force was not justified regardless if the students were in the right or the wrong.

wel if the students were breaking the law, throwing things at the cops, and spitting on them that use of force is justified.

during situations like these people forget there is a time an place for force like that. It just might not be THAT time and place.

What law did they break? Not cooperating with a police investigation is not obstruction. All of the charges stem from after the cop infringed on their rights.

Well, that's not what happened, was it?

That shite looked like a scene out of a ww2 movie. fricking gestapo. It's sickening.

They would do the same thing to kids playing their music too loud in Nazi Germany.

They broke an ordinance (maybe, as there is some suspicion that the cop responded to the wrong address). The cops are the only ones in the video who are breaking laws: unlawful entry, abduction, unlawful detention, assault, harassment, etc.

It cuts out any of the relevant footage.

Shows more than enough footage to show the police were 100% in the wrong in starting confrontation since initial encounter is included (extent of force might need more) According to the supreme court without a warrant

quote:

nd whether the person who knocks on the door and requests the opportunity to speak is a police officer or a private citizen, the occupant has no obligation to open the door or to speak. And even if an occupant chooses to open the door and speak with the officers, the occupant need not allow the officers to enter the premises and may refuse to answer any questions at any time.”

Without a warrant you are not required to leave your residence nor are you required to speak with police when in your house. There is no reason to believe there was an invitation for entry either considering the door was not open enough for entry of any person.

The usual standard in Oxford is someone goes outside and talks to the cops. Cop says "If I have to come out here again then I'm shutting it down and checking ID's and looking for anything illegal. Kids say "Yes sir" and then the music down. Problem solved.

I'm familiar with that system. Have seen it in work. It's effective and pretty pleasant for all involved. Seems like it would have been a great idea.

The stupid cops are lucky they aren't dead. At the very least they should be arrested for home invasion / assault / unlawful detainment and any other ridiculous charge that could be applied.

Finally, they should spend some time in the FPMITA Prison.

So exercising your constitutionally protected rights upheld in multiple supreme court rulings is now being disrespectful?

If someone is being courteous and acting within the law and their rights, that is the "respect they deserve."

You can watch the cell phone video the kids shot and tell that they edited it, which is incredibly stupid on their part, especially when the cell phone video was available first.

They definitely deserve punishment for infringing on their rights.

Criminal punishment for excessive force and assault though is only able to be determined if there is justified reason to fear for their safety.
