Please post pictures of the tree from which the branch fell. There is no strict liability in Louisiana. However, if the tree is clearly dead the owner would be on constructive notice of the hazard and would be liable. If the tree is green then it would be harder to prosecute a claim.

Though there may be some inherent rot inside the tree if there is no visible evidence the tree is severely diseased or dead you would have an uphill battle with most carriers. You can file a comprehensive claim under your policy. If your carrier subrogates against the tree owner and successfully recovers you will recover your deductible.

yes, and it doesnt take much for a brisk wind to cause some loose/rotten branches on a pecan tree to fall and do some damage like in the Po

well this is a reason of insurance. If it is someone elses fault your insurance company will go after them.

Pay the deductible, get it fixed, move on.

At least it was your vehicle and not your life. Poor guy in Baton Rouge died this morning when a tree fell on him.

As someone who dealt with a lawsuit over this at my business I can tell you it's a waste of time. I was sued by some shite lawyer and wasted money on a good attorney who resolved it all quickly and then the guy who sued me had to pick up the tab. It was a great day, but a waste of my time

tree fell on the current TX governor, he sued the hell out of everything in sight, became a wealthy man, and then as AG of TX crusaded to change state laws to prevent people from doing exactly what he did

Gustav dropped a tree limb from my yard onto a neighbors car.

I like them and they are good neighbors so I paid the deductible. 500$

doubt that happens often.

THIS is how it is supposed to work. This isn't how it actually works though. My damn neighbor hired a lawyer to send me a letter about mowing the lawn.

They both looked pretty stupid when I pointed out that the piece of property they were bitching about being mowed actually belongs to HER and not me. I was just mowing it to be nice. The concept of "neighborly" has gone away.

thats awesome. to be fair it was a tree I had told them I would get cut back for years. it wasn't over the property line but it needed trimmed. maple tree
