This is why you don't talk to the police before talking to a lawyer first. This wording is what they'll hang their hats on.

With everything that's going on she had reason to fear.

True. However, I don't know what jury would convict her.

Especially when the perp said they were there to steal from her.

How dare she. She has insurance.

For all the idiots out there that make these statements, I’d like someone to do two things to each of them:
1. Steal their phone
2. Get an uninsured person to wreck into their car.

She is 88 years old. Her reaction time is far slower now than the past. If she does not get out in front of the robbery, then she may not live to 89.
Why doesn't someone tell the thieves that no one is allowed to go behind the counter. There is only one reason for them to do that. Their intent was to rob her, and who knows what else.
Whoever arrested her and whoever approved of the arrest need to be suspended immediately.
What did they expect her to do? Take a punch to the face first?

Pfft, she showed them her insurance, the gun. Taught them how her insurance policy works too.

None of this is even relevant. It’s also not relevant that he admitted they were trying to steal. You can’t shoot someone defending property. Unfortunately she’s going down if this is what she’s hanging her hat on.

Later in the article it says he lunged at her. This is the key fact as to whether she was in fear of her life. Although it states elsewhere that he was shot in the back. Not looking that great for Granny.

Police caught up with Fisher at Vanderbilt Hospital, where he told police he was under the influence of drugs and alcohol at the time and said he and his friend went to the store to steal liquor, the affidavit says. This is exactly why when you pull the trigger, you better kill someone. Being a bad shot never pays off.

They're not throwing 88 year old grammy in the slammer for shooting a thief in the arse . If she is convicted it's almost certainly a stayed sentence.

Hopefully she has her mugshot framed on the wall at her store to serve as a reminder
