When you work in the system (speaking from a WC standpoint), you know exactly which doctors are either pro-Def or pro-Plnt. Attorneys and/or adjusters will send the injured worker to a specific physician already knowing what the claimant's return to work prognosis is.

(B) After a thorough evaluation of the patient and review of his diagnostic test results, Mr. Doe is diagnosed with a soft tissue injury and he may return to work at full duty, with no restrictions.

IMO it is legal extortion. I’d also like to see many of these firms get slapped with false advertising. Here in Central Florida they all advertise they are “the aggressive” law firms to fight your case in court. Most show in commercials their attorneys in the court room. I have it on good authority that a lot of them have never taken a case to court. SMH

There are no viable alternatives or cures that would have any chance of passing the Louisiana legislature (also corrupt). Tort reform is impossible as long as the lawmakers are predominantly lawyers with a vested interest in the rigged system.

We need true loser pay so the successful lawyers will get paid regardless of the size of the claim on cases where the defendants are wrong. The defendants will have plenty of incentive to settle and the plaintiffs lawyers will have plenty of incentive to go forward with good cases and not to worry with bad or fake cases.
We also need civil matters to be handled by a court of appointed judges. A judge panel of 3 judges that are each random assigned to a case.
The Commonwealth countries have loser pay and they seem perfectly fine with it and much less litigation than does the USA.

Sometimes they grow back, sometimes not. My dad got his done 18 months ago and so far so good.
