When has whether or not there is such a thing as war criminality ever stopped a warring party from doing something that it thought would help them win the war?
It’s the same thing with “international law” it’s a dumbass concept that no nation actually follows. Least of all the United States. And nor should we.
There’s never, not one time, ever been a war in which atrocities do not occur. From Cain killing Abel to the Ukraine-Russia war. So, it seems to me, until you’re willing to admit that all war is a criminal act, none of it is.

I do understand the concept of a war crime, but in the case of nuking Japan, I dont believe it would fall under that definition. Both cities had a significant number of military targets which could've obviously been targeted with conventional bombs and no one wouldve considered that a war crime. So the thing in this case would be the difference from the fallout from the weapon itself of said military attack. And if civilian deaths as the result of a military attack are in itself a war crime, every bomb ever dropped on a factory or munitions plant where private citizens are known to be present would be considered a war crime as well, no?
Of course I am by no means knowledgeable of what exactly constitutes a war crime, but if that indeed meets the definition, you are on a slippery slope every time a bomb is dropped.

There has not but we have differentiated war from civil life.
Example: soldier are not prosecuted for murder when they kill their soldier adversaries in the course of regular warfare (exclusion are torture etc.)
War brings on a different set of "rules" (Geneva Convention, International Criminal Court)

IIf the winning side commits a so-called "war crime" then who is going to prosecute them for this? Had the Nazi's won who would've conducted Nuremberg? Would what the Nazi's did still be a "war crime"? IThere is no such thing as a "war crime". The winning side does as it pleases after the war.
