Activist DA's will go after 2A by prosecuting self defense.

Having served on a grand jury this means they told the DA he has enough information and facts to go forward with a trial.

BLM baw fricked around and found out. Point an AK-47 at a baw in Texas without expecting a situation that could result in one or both of you being killed? Well that's just dumb. And the baw defending himself against the baw with an AK-147 should definitely not be charged with murder or anything.

I think this is a harder case than most want to recognize. And I say that even though I think the soldier likely shouldn't be charged.

A lot of the same people outraged about this support armed protests against lockdowns, etc. And if in Michigan one of those gravy seals gestured at a counterprotestor or driver with an AR, and got blasted because the other guy perceived a serious threat, would the takes be the same?

They should be. My biggest takeaway is that this is the cost of 2A rights bumping up against one another. It's high stakes for both sides, and everyone has to act accordingly.

This makes no sense. This happened in Texas?

Austin is not really Texas. Austin has become more California than Texas.

It’s still PoliBoard shite. And your way over the top reaction shows that it belongs there. Post a babe thread to atone for your crimes.

I’m not accusing you of anything. This is an OT board. That’s politics.

I couldn't find any. The only place I saw that said the victim pointed his gun at Perry is a statement from his defense lawyer. The DA had 22 eyewitnesses testify to the grand jury.

Not really taking a side in the case, but it doesn't appear as clear cut as this thread portrays.

There was video and pics of the incident all over the place when it originally happened, and in the video Foster very clearly shoulders his AK pointing in Perry's direction while standing maybe 6ft from the driver's window.

I'm sure video and pics are still out there if you actually TRY to look and don't have an agenda, but you're The Spleen so....

definitely shouldering the AK and pointing it in the driver’s general direction. looks like a pretty cut and dry case if you’re not in Travis County, Texas or you aren’t poster, The Spleen.

Depends on who really threatened first.

It looks like that's where it's naturally hanging from the shoulder sling to me, but he shouldn't get the benefit of the doubt after attacking a car with the rest of the mob.

Defense should just focus on self defense or castle doctrine, IMO. If there's a mob attacking my car and I see a guy with an AR, I'm not waiting to see if he shoots first.

Agreed. I am in no way saying it wasn't justified. Hell, I am at the point now that they can shoot all of them and I would vote not guilty if on the jury.

maybe it isn’t as cut and dry as i suggested, but he isn’t firing down range in this this scenario. he would aiming/shooting at someone who’s center of mass is at least 2-2.5 feet lower than Cole’s shoulder.

i believe there is most certainly video of him aiming, not just shouldering the weapon. I’m going to keep digging. I know Tim Pool and Crowder both did breakdowns of the video. They have to be out there somewhere if Google hasn’t scrubbed them off the internet.
