What if, at her desk on her work desktop, she left her personal Gmail account up and didn't lock her computer and walked away.

Same thing happens, slimy kid gets on her computer, finds nudes of her in her sent emails and emails em out to other kids.

Still not her responsibility? I'm really wondering how important how the photos were stored will matter, if at all.

that's not even the same thing. one is he personal property that someone stole. One is company property which shouldn't be used for personal stuff anyway.

no assumption of privacy on company equipment.

If the image is not local and is stored on a server then how is it any different than if the kid had stolen her phone and gone to a website? By the arguments of those saying it is the teacher's fault then if the image is stored on a server and not on the phone physically then it is no different than the kid looking up fappening or r/gw images.

So if I were to send a dick pic to a teacher right now, and a kid in her class did what this one just did 5 minutes later, the teacher should be fired?

Accessing a pic in iMessage is just as easy as accessing one in a phone's camera roll. And semantics aside, using the argument that she "brought a phone with porn on it to school" school should still apply, no?

Exactly. It's very blurry gray area. I'm only suggesting that employers stay out of what's on a personal device b/c everything is too connected to nitpick regulate.

Reinstate the teacher, make it policy that all personal phones on campus are passcode protected when locked. Expel the kid(SC needs revenge porn laws ASAP). Move forward.

No doubt about this. It truly unfortunate for her. But, I'd say the reason it's wrong to have that on your phone would be because this could happen.

People can say what they want, but what the kid did was not theft (in regards to accessing the phone, not distributing the picture). It may have been wrong and against the schools rules, but it isn't theft. If you leave your phone on your desk and I pick it up, swipe and start looking at texts, I love for you to call the police on me. I'm sure they'll rush over and arrest me for "theft".

I don't think she was in the wrong per se. I more think that the school has an argument and can stand behind their decision from a legal standpoint

I get into your unlocked vehicle and start rummaging around, you call the police. What is the difference? Both are personal property that the person accessing knows does not belong to them.

I actually agree that the school can fire her if they feel it's in their best interest.
