The Albanese government says it cannot intervene in the case of a 16-year-old cancer patient whose family says she is being denied a lung transplant because of refusing the Covid vaccine as her condition continues to deteriorate in hospital.

Leukemia-sufferer Dazelle Peters is fighting for her life in Newcastle's John Hunter, north of Sydney, with father Josh Peters saying her condition continues to alarmingly deteriorate because her lungs are 'buggered'.

Sydney's St Vincent's hospital says Dazelle's lack of a Covid vaccination is a factor in her not being put on the lung transplant waiting list, but says there are other reasons beside that.

Since undergoing a May 2021 bone marrow transplant Dazelle has suffered from Graft-versus-host disease, which causes her body's immune system to attack donor's blood cells.

She has also contracted a rare form of pneumonia, which the hospital says makes Dazelle a potentially immunocompromised patient that needs to be vaccinated.

A hospital spokesperson confirmed their 'policies and guidelines wouldn't support transplantation' of an unvaccinated person.

'Vaccination status against various infections is a critical part of this assessment in order to ensure optimal prospects of survival post-transplant,' a St Vincent's hospital spokesperson said.
