This is just the case of the mom being a petty bitch. The kids walked in on them, not the other way around

Is THAT reason enough to charge her? I still don't think it is.

Last I checked, it wasn't illegal for consenting adults to screw in a house, behind a closed door, if the kids are home. If the kid walks in, that sucks and will lead to some challenging questions, but not illegal and not subject to 10 years of sex offender reporting.

And for those of you who say "oh the ex just wants to get back at them", I get that, but why is the police and prosecutor going along with this?

The story I read was that they were doing drywall work in the garage. Before they went back into the house they took their tops off to not get dust in the house. When they went back into the house is when the step kids saw her.

yeah they were clearly fricking or trying to frick in the garage, and the kids walked in on them. Is there some kind of law in Utah against having spontaneous sex in the garage when your kids are home??

You're not supposed to have sex in front of kids. It's against the law everywhere in the US.

It's against the law to just be naked in front of kids let alone banging.

Ummmm there's a law pretty much everywhere called "Indecent Exposure" and it will get you on the sex offender list.

Being naked in front of your kids isn’t indecent exposure.

Here’s Louisiana’s statute on indecent exposure:

A. The crime of obscenity is the intentional: (1) Exposure of the genitals, pubic hair, anus, vulva, or female breast nipples in any public place or place open to the public view, or in any prison or jail, with the intent of arousing sexual desire or which appeals to prurient interest or is patently offensive.


Getting out the shower with your 5 year old in the bathtub is in no way, shape or form indecent exposure.
