Any help appreciated. My wife (no pics) was born with scoliosis. She is 60. She has had 3 back surgeries and rods neck to hips. I make 70 to 80k year. She says I make too much money for her to draw s.s. disability. Anyone know if there is a limit of income of a spouse for her to draw?

Thank you for bringing your issue to the OT. May we have your wife’s social security number and date of birth to better assist you?

Go to the social security office and talk to them....I have found them to be surprisingly helpful when you have questions of this nature.

I don't think your income should matter, but check with a reputable lawyer. Most decent sized cities will have a couple of firms that focus on this.

instead of getting bad and/or incorrect advice here, why not go read the rules at their website or just call the 1-800 number and wait 15 minutes on hold like everyone else does and then ask soc sec what the rules are?
after all, you dont want to get a call from the IRS do you?

Is she working now? Do the back surgeries she had in the past make it to where she can not work currently?

she cannot work. But she was not working before surgeries.

For SSD, the spouse's income does not matter.

She can't do telework while laying down in her bed?
Call centers?
Word processing?
Are you saying she can't do shite?
She sounds lazy and why should my tax dollars be used for that?

That might be a problem, has she never worked? To get disability you have to of worked so many quarters ?

I expect some of that from some people. But I've found some helpful and highly intelligent people on the site. We all have something in common. We love lsu.

Income only comes into play with SSI.
With her not working, you might run into trouble with tax credits.
I'd call a lawyer if I were you. Most, if not all, SSD attorneys are a contingency based so you won't have to pay an attorney fee unless she gets benefits awarded. Though that does not always cover the cost to process a case, so that's something you'd need to ask individual lawyers.
