Courts can demand repayment, maybe not in every state

Wtf spousal support

Not fault driven like alimony.

Spousal support and alimony are the same. If a divorce is sought on grounds of adultery, the alleged adulterer can receive interim spousal support until the divorce is signed and if it's granted on grounds of adultery that spouse is barred from receiving spousal support going forward. None of this applies to child support.

Man I'm happy to report I havent done a divorce in 15 years but interim spousal support was a property right, he/she makes more money so the bigger earner has to pay interim for 6 months to soften the blow of the removal of that income from the community.

Alimony was associated with fault and the ability to pay. The only time I saw it awarded was some oilfield goon beating on his wife in a wheelchair (she had MS).

What state do you live in that would allow child custody to be controlled by a pre-nup?

^This. My ex wife is paying me part of her retirement. For life. After taxes.

That's completely normal to split pensions, IRAa, 401ks with a spouse b/c every contribution while married is treated as co-mingled income aka "$$you earned and would have spent together."

Difference is most people settle on that issue and don't force the ex to 'cash out'. They usually settle by trading an asset(I let the ex keep profit on house sale)or do like you've done and have an agreement for disbursements.

You 100% didn't need an attorney for that.

In today's world if you do not get a prenuptial agreement signed you are a big dummy.

A prenup is like a patent, it is only as good as your ability to pay for its enforcement by the court.

I don't believe you because that's not how it works. Only way would be through a specific agreement between you two

That's exactly how it worked, sir. My ex is a commander in the Navy. We were married almost 10 years. She was caught in an affair - however, against JAGs advice, I didn't turn her in...which, the reason rests solely on money and healthcare for the kids. Had I turned her in, she would have been booted from the Navy and lost everything. I am getting close to 1K a month after taxes from her retirement. For life.
