Nevermind. That's irrelevant.

Smith Shooter's Lawyer "My Client Was Not The Aggressor" by arseinclarse
I witnessed a pretty bad accident on Claiborne about five months ago. No one would answer. After about ten tries I started calling Nonemergency . They had options for English and Spanish. I said frick it. They called back about twenty minutes later.

That's just part of the charm of New Orleans

I'm pretty sure that everyone knows that he did it so I think the guilt or innocence thing is just a formality.

why is he a thug?

He's a thug because:
1. First shot will smiths wife in both knees

2. Shot will smith 6-8 times in the back.
3. Shoots and kills over a fender bender.

Dude is a complete THUG and like all thugs, should be locked up in a cage for the rest of his thug life.

If you apply the definition correctly, Smith was a thug as well for dragging his wife by the hair.

I don't understand this. You couldn't ask for a more fair, objective, impartial person than me. I believe everyone deserves a fair trial.

It's not a question of whether or not he will spend time in prison. The question to be answered in court is whether it's a degree of murder or manslaughter.

Had Smith pulled over and just swapped insurance information with Haynes most likely this thing is a non-event. Hell, upon seeing Haynes has a little bit of size and learns Haynes plays semi-pro football, maybe even a friendship of sorts could be established.

But Smith ran. Bitch move.

From what I have read so far, Haynes is guilty of something. I don't know what. Murder 2 seems too strong. Negligent Homicide doesn't seem strong enough. Manslaughter sounds right. But I don't know enough about the law to know which charge is moist applicable.

Root cause of the situation is, had Smith not chosen to drive (most likely intoxicated) a motor vehicle causing an accident, none of this would have happened.

Had Smith not chosen to flee the sight of an accident he had caused, he would still be alive and his wife would not have been shot.

Smith had 2 great opportunities to prevent any of this from happening.

Seems like people here think there has to be a winner and loser. There is just a whole lot of stupid by both sides in this accident.

The fact Smith was a Saint has definitely made some narrow minds here rush to judge.

So it's ok to shoot someone over a fender bender, as long as they had 2 chances to avoid the situation beforehand? Their "fault" isn't even remotely comparable. There is no defense for shooting someone 7 times in the back.

You're an idiot.

Hayes also had several opportunities to prevent this from happening, and was the one that pulled the trigger 10 times hitting two different people and killing one of them. If he swallows his pride after the supposed tap that caused no damage to his vehicle, or if he doesn't speed off following Smith after supposed tap that caused no damage, or if he doesn't forcefully rear-end Smith causing a broken back glass and visible damage to the spare tire carrier, or if he doesn't get out of the safety of his own vehicle with a firearm (that he's not legally allowed to conceal), the verbal altercation never occurs and he's a free man today.

Saying Smith's actions caused his demise based on the facts as we know them today is absurd.
