-had smith not drank and drived he would still be alive
-had smith not hit and run he would still be alive
-had smith not jumped out the vehicle and confront hayes he would still be alive
-had smith not threatned he had a gun (according to witness) he would still be alive

Yeah and had Haye's parents not had sex, this whole thing could have been avoided!

We can do this all day if you'd like. The truth is that both (based on what we know) had multiple opportunities to diffuse the situation, but both chose their paths. Both lost.

That's easy to say. It's also easy to say , had Will Smith not drank and bumped his car, all of this is avoided. That's not my argument but that is the same thing.

The difference being Smith accidentally bumped Hates. Hates intentionally escalated.

Drunk is debatable but the restaurant admitted that he drank while there.
