well at the end, he clearly said there was stupidity on both sides though - which is true.

Saying they are the root cause is entirely accurate.
In my post I said both Smith and Hayes actions were wrong.
But you're obviously a Saints fan and have already decided.

If this isn't sarcasm, it's one of the most retarded things posted in this thread.
Both families lost in this case, and both will be hurting for years. This whole case is a lose/lose.

This x 1000
Had Hates simply called his insurance and continued on his merry way, all of this is avoided.

yes it was sarcasm and referencing Rebel's prior post

well thats the truth.
-had smith not drank and drived he would still be alive
-had smith not hit and run he would still be alive
-had smith not jumped out the vehicle and confront hayes he would still be alive
-had smith not threatned he had a gun (according to witness) he would still be alive

Yeah and had Haye's parents not had sex, this whole thing could have been avoided!
We can do this all day if you'd like. The truth is that both (based on what we know) had multiple opportunities to diffuse the situation, but both chose their paths. Both lost.

Oates, Salty is responding to my post where I raised the question that the more narrow minded people in this thread see this as win-lose situation.
Chad, BR, and Ben for example thinks and hopes Hayes is executed for this.

That's easy to say. It's also easy to say , had Will Smith not drank and bumped his car, all of this is avoided. That's not my argument but that is the same thing.

The difference being Smith accidentally bumped Hates. Hates intentionally escalated.

the "accident" may have very well been an accident. Won't even bring up the question about being intoxicated.
I'm not sure if that's the correct word, but I can agree to that.
Did Smith accidentally flee the scene?

Did he also accidentally threaten that he had a gun?
ETA: Also, this thread would probably be 30pgs shorter if Bencol didnt have
This much space wasted in every post.

One things for sure though. Hates didn't accidentally pump 10 rounds into the Smith's.

Link to toxicology saying that Smith was driving drunk?

Drunk is debatable but the restaurant admitted that he drank while there.
