No. That's why I said verbal altercation.

Obviously if Hayes drew first and THEN Smith made a move to get his gun then Hayes will be going to prison for a long time. We do not know for a fact if that is what happened. Maybe it did. We don't know.

That is why the leadup will matter. Hayes got hit from behind by Smith. Smith then does hit and run. Smith runs through red light at dangerous intersection. When they get into verbal altercation Smith announces he has a gun then reaches into his car. The defense argument will be that he had to take the threat seriously from somebody that had just exhibited lawlessness (and we will see if drunk driving is another one). I am sure they will say what he reached for looked like a gun and he thought he was seconds away from being shot himself.

Yeah, I'm thinking that establishing who pulled the gun first is going to have a major bearing on the outcome of this case.

That was completely avoidable
Zimmerman didn't have to follow Trayvon. That was completely avoidable....

What matter is was Smith justified in threatening using a gun? If so, Hayes committed murder

If Smith was not justified in making that threat, Hayes will have a chance at self defense

I'm not going to lie, when they brought Ronal Serpas over from heading Nashville, I thought we had someone that would actually move the dept in the right direction, but boy wasn't I wrong.... It's like no matter what they entire police force automatically by default, shits the bed.

im pretty sure it started when someone did a hit and run.

But im talking about this scenerio only. Personally i am not going to be out cussing and fighting anyone over a car accident. I was only speaking on hayes behalf this particular situation. Both men were in the wrong here, and bad things happend

This is my thoughts as well. Smith paid for his mistake with his life. The question is, what price will Hayes pay for his?
