What if the other person pulls their gun first, and you are pulling your gun in response? You still think the first guy that pulled the gun is justified simply because you were going for your gun to protect yourself?
No. That's why I said verbal altercation.
Obviously if Hayes drew first and THEN Smith made a move to get his gun then Hayes will be going to prison for a long time. We do not know for a fact if that is what happened. Maybe it did. We don't know.

So, I can provoke you into going for your gun, then shoot you and blame your death on you?
Looks like i would have 2 choices if you told me you were getting your gun in that situation.
1. wait until you shoot me to see if you are bluffing
2. Shoot you
Its always better to be judged by 12 than carried by 6

The NOPD lacks the collective intelligence to frame (or unframe) anyone.
And there is my problem with all of this speculation.
I have no faith in the NOPD or the Orleans Parish DA.

That is why the leadup will matter. Hayes got hit from behind by Smith. Smith then does hit and run. Smith runs through red light at dangerous intersection. When they get into verbal altercation Smith announces he has a gun then reaches into his car. The defense argument will be that he had to take the threat seriously from somebody that had just exhibited lawlessness (and we will see if drunk driving is another one). I am sure they will say what he reached for looked like a gun and he thought he was seconds away from being shot himself.

Yeah, I'm thinking that establishing who pulled the gun first is going to have a major bearing on the outcome of this case.

Don't forget the 3rd choice. Don't follow someone and start shite over nothing.

Mayor Mitch and his cronies are gonna make a strong push to convict Hayes to try and win the public back

Don't fricking hit and run

Hayes didn't have to follow him, hit Smith, then shoot him.
That was completely avoidable.

Coach was right. It's the wild, wild west.

What matter is was Smith justified in threatening using a gun? If so, Hayes committed murder
If Smith was not justified in making that threat, Hayes will have a chance at self defense

Have to love the NOPD making arrests, then doing their investigation.
I'm not going to lie, when they brought Ronal Serpas over from heading Nashville, I thought we had someone that would actually move the dept in the right direction, but boy wasn't I wrong.... It's like no matter what they entire police force automatically by default, shits the bed.

Actually the poor choices likely began hours earlier. 10-1 they were both drunk.

im pretty sure it started when someone did a hit and run.
But im talking about this scenerio only. Personally i am not going to be out cussing and fighting anyone over a car accident. I was only speaking on hayes behalf this particular situation. Both men were in the wrong here, and bad things happend
Posted on 4/12/16 at 1:24 pm to oleyeller
See above. Bad choices everywhere. No big men left standing. Only destruction and misery. Over frick-all nothing.

This is my thoughts as well. Smith paid for his mistake with his life. The question is, what price will Hayes pay for his?
