I think there's some obvious things being missed and overlooked. Behaving like a thug, then someone feeling the need to protect themselves w a gun doesn't give thug the right to shoot.

The people who didn't get shot and die are gonna put this guy away forever with their testimony.

Like the shooter felt justified enough in his actions to stick around and talk to the cops and be arrested of his own volition?

I think you're right in that we're not getting all the pieces of the puzzle.

If the forensic evidence proves that Smith was shot in the back as he was getting back in the vehicle as well as the fact that Hayes followed Smith and rear-ended him on purpose as a result of a previous hit and run, the guy has zero defense. There is nothing in "Stand Your Ground" that says you can follow a threat and kill them. I'm a licensed conceal carrier and cannot shoot anyone just for them saying they have a gun. The only way I can legally shoot someone is if they are committing a felony and putting another life in danger. Based on eye witness accounts and the evidence shown to date, Smith was not putting anyone else's life in danger.

If an eye witness come forward and says Smith pulled his gun and was about to shoot Hayes, we have a different story. If this were the case, Smith would be shot in the front and not the back.

Farquad, your black and gold panties are showing. I'm not saying Smith was in the wrong. I'm just saying it's way too muddy at this point to be "sure" about anything, and anyone else claiming otherwise is simply talking out of their arse.

I got rear-ended by a drunk driver and never once thought about pulling my gun and shooting him.

It pisses you off, but you can't kill anyone over it.

shite happens in life, escalating a situation rarely ends well.

That's not at all what you said. Go back and read your post.

That's the problem with some people in this thread. They make blanket statements as if it were fact. And the truth is, it's not fact at all. You mentioned nothing about immediate danger. And you have no earthly idea whatsoever if this guy "thought he would be shot right then and there", like you stated in this post. Are you a mind reader?

The truth is, there are multiple tiny variables that can change so many blanket statements made in this thread. But trying to get people to admit they are talking out of their arse is pretty much impossible.
