2 things i think probably happened here

1. Hayes was no doubt illegally concealing a gun that he didnt rightfully own

2. Smith wasnt yet aware that Hayes had a gun of him at the time he retreated to his truck to grab his. Lets face it, this isnt the wild wild west. Hayes didnt say, "heres my gun, go grab yours and lets duel!".

Smith probably would have been much more submissive had he known Hayes was indeed packing heat.

so you leave out the eyewitness account that both men were indeed irate with one another?

yet you already have Hayes as the guy running around with his shirt off(to whom that was actually hasnt been identified yet)

That has to be a troll. Fatal mistake to not think the guy irate could have a gun

Even in the heat of the moment, with Will Smith's status, desire to be an FBI agent, and intuition would dictate you approach anybody at 12:30 at night in New Orleans this way....

Not blaming Will and think the other guy is a piece of shite regardless of justice system procedure.......

Will may have been sauced up. Toxicology reports will tell the story.

Not usually the case if you would be brake checking. Usually need to be moving to do that and after brakiy, you would be even further from the front car.

why do you think that is a troll?

If Hayes had brandished a gun earlier in the encounter, why would Will Smith continue to push the guy? Especially with his wife with him? Especially if he didnt have a gun on his persons

I have no doubts he was intoxicated.....I would have been too.....but I don't carry a gun on me when I drink and I'm not leaving my car drunk at 12:30 at night to approach anybody with my wife in the car(my gun is in my car otherwise)......as long as I stay in my car I'm protected by the castle doctrine and I can fire if you threaten my life like it's my home.

quote:

The statute says a homicide is justifiable when “committed by a person lawfully inside a dwelling, a place of business, or a motor vehicle … against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, or who has made an unlawful entry into the dwelling, place of business, or motor vehicle, and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the premises or motor vehicle.”

Call me a profiler, but in that position in the middle of the night in New Orleans, and I am assuming he has a gun.

Everyone wants to act tough and carry guns this is generally the result - simple confrontations lead to shooting deaths.

i mean 11:30pm isnt really "middle of the night" for New Orleans.

And you are saying you think Will Smith would have knowingly engaged with this thug had he known or suspected he had a gun?

and the noted comment of very few we have here, will smith is telling the guy to leave. (which most likely the first time will was telling him to leave)

What's Hayes' reason for shooting Mrs. Smith?

That's like saying if I didn't think going down a dark alley in a bad neighborhood was dangerous I would do it.

Again, there is a reason we profile. Announcing to a thug I am going get a gun because I am just blindly hoping he doesn't have one would never be considered good advice.

Missing Will, which would be correct if aiming down in the car and hitting her legs.

28 year old dude that just chased him down is somewhat reasonable to guess may be packing

I wonder if the shirt off was smith and that's why 1) he didn't know other guy had a gun and 2) the lawyers say booze or drugs would explain his erratic behavior?
