It’s still completely out of touch with reality. Easy for them to advocate for this when they are shielded from the consequences.

exactly

"blatantly racist" usually has nothing at all to do with racism, like "siding with trump" and your example.

it's really just "i don't agree. i want to ruin you"

Defamation. One thing to post a screenshot. Another to call someone a racist without evidence.

Cyberstalking is a crime for one. Also pile on civil damages.

I think libel could apply here depending on the statement made. Equating someone’s innocuous statement to being racist would be a good case.

Ms. Jackson posted that tweet claiming a girl was a racist because she said she doesn’t believe there is oppression in America.

Ms. Jackson has 6M+ twitter followers that presumably some have contacted said “racist” girl who now has to defend her name against false accusations.

No Defamation Claim for Being Labeled a Racist

Winning a defamation claim for name-calling is going to be an extremely uphill battle that very likely ends in defeat and a bunch of legal expenses.

And I doubt reposting social media posts and labeling them as racist meets the elements of Cyberstalking.

What claim are you getting civil damages under?

Do You really think that was the point? I guess you feel if you can hire there own security and protection from criminals then it's ok to let the poor fend for themselves.

Also are you like every protester ignoring that Chavin was arrested and charged (the next day) and will face justice system? It's the dumb arse state AG that might be screwing up prosecution.

This is a solid post about why there's no civil suit. The paragraph in your article that says it all is:

quote:

McKelvy disclosed the facts – the classroom exercise gone awry – and let his listeners know his feelings about those events.  In his opinion, Cummings’ behavior was racist.   In her view they weren’t.  But therein lies the issue – how does one prove the other is lying?  You can’t.  And that’s why the court dismissed the claim.

That's all this woman's twitter account seems to be doing. Posting screenshots of social media posts and adding her own opinion.

I don't know how you'd ever get past that.

From your link:

quote:

According to McKelvy, the problem with Cummings’ complaint was that she could not prove McKelvy’s statements were false. A plaintiff has to prove a statement is false to proceed on a claim for defamation.

Which is correct. The difference here is Ms. Jackson made a specific comment that she's a known racist in her friend group.

Pretty much can’t. Not condoning doxing high school kids to millions of people, but unless some state has a very liberal cyberstalking statute, there is no legal recourse for being called a racist.

I know you guys really want to sue this person, but that’s not going to get you a defamation verdict.

One big problem is that people are sending these to here and she is too stupid to know how to check them out. What if I cut and paste one and send it and it gets published and that person's life gets ruined?

Just a second I have a bit to edit before I send.
